Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Grass field at thegrass.online, touch.thegrass.online, portrait-on.thegrass.online, and related pages (the “Service”). By using the Service or painting on the field, you agree to these Terms.

If you do not agree, do not use the Service and do not paint.

Operator and contact

The Service is operated by Vladimir Bikmeev, based in the Kyrgyz Republic (“we”, “us”, “our”). Contact (including complaints about content on the field): bikmeev.vladimir@gmail.com.

What the Service is

Grass is a shared interactive field of grass blades. You may touch, pan, and (on sites that allow it) temporarily color blades. Painting is collaborative and temporary.

Colors, layouts, wind, brightness, and other effects are provided as-is for amusement. Appearance on the field is not our endorsement of any drawing or message.

Eligibility

Painting

Behavior depends on which host you use:

By entering edit mode or saving colors on a shared-paint host, you agree that your contribution may be overwritten, expire, removed, or discarded without notice. On Portrait-on, Cancel discards the current edit session’s strokes relative to when you entered Edit; leaving or refreshing the page clears local session drawings.

Your content — you are responsible

Paint colors, stamped images (when available), and any other material you submit (“Your Content”) are yours to create, but you are solely responsible for them. We do not create or endorse Your Content. Other visitors may see drawings that offend, upset, or harm them on shared-paint hosts; those drawings come from users, not from us. On Portrait-on, Your Content is local unless you choose to share a downloaded file yourself.

By painting, you represent that:

To the fullest extent permitted by law, we are not responsible for what people draw, for how drawings affect others, or for disputes between users about content on the field.

Complaints and removal

We do not pre-moderate drawings before they appear on the field, and we do not systematically post-moderate (review or police) drawings after they appear. Paint is user-submitted and may be visible to others until it expires, is overwritten, or is removed. Seeing something offensive does not mean we approved it, monitored it, or failed a duty to screen it.

If you believe content on the field is unlawful, abusive, or otherwise violates these Terms, email bikmeev.vladimir@gmail.com with enough detail to find it (for example where on the field and when you saw it).

We may, but are not obliged to, look into a complaint. We may refuse, hide, expire early, or remove any paint, with or without a complaint and with or without notice, including where we believe these Terms or the law may have been broken, or where legal, security, or reputational risk appears. Reacting to a complaint (or choosing not to) does not create an obligation to monitor the field, endorse remaining content, or accept liability for user drawings.

Prohibited use

Our intellectual property

We own the Service and its related intellectual property, including software, designs, layout data, branding, and the field experience as provided by us. We grant you a limited, non-exclusive, revocable license to access and use the Service for personal, non-commercial amusement as these Terms allow. You may not copy, scrape for redistribution, reverse engineer (except as mandatory law allows), or exploit the Service commercially without our written permission.

License you grant us

You grant us a worldwide, non-exclusive, royalty-free license to host, cache, reproduce, adapt (for display and technical formats), and publicly show Your Content on the Service for as long as needed to operate, moderate, and show the field. Visitors may see that content while it remains on the Service. Feedback or ideas you send us about the Service may be used by us without compensation to you.

Availability and changes

We provide the Service as-is. It may be unavailable, slow, or incorrect. We may change paint duration, hosts, or these Terms. If a change is material, we will update the date at the top of this page. Continued use after a change means you accept the new Terms.

Disclaimers

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, that colors or timings are accurate, or that the field is free of offensive or unlawful user content.

Limitation of liability

We do not limit liability that applicable law says we cannot limit. Subject to that, and because the Service is currently free of charge:

If mandatory law requires a non-zero minimum despite this, our liability is limited to the smallest amount that law allows.

Indemnity

You will defend and indemnify us from claims, damages, and reasonable legal fees arising out of Your Content, your breach of these Terms, or your infringement of someone else’s rights, to the extent permitted by law.

Governing law

These Terms are governed by the laws of the Kyrgyz Republic, excluding conflict-of-law rules that would require another law. If you are a consumer with mandatory local protections that cannot be displaced, those protections still apply. Where you are not a consumer, disputes may be brought in the courts of the Kyrgyz Republic to the extent permitted.
